Go read ‘Letter from a Birmingham Jail’!

One who breaks an unjust law must do so openly, lovingly, and with a willingness to accept the penalty. I submit that an individual who breaks a law that conscience tells him is unjust, and who willingly accepts the penalty of imprisonment in order to arouse the conscience of the community over its injustice, is in reality expressing the highest respect for law.

For Martin Luther King, Jr.’s birthday – the holiday is tomorrow, but the actual anniversary of what would have been his 83rd birthday is today – I recommend that you read Letter from a Birmingham Jail, written 16 April 1963 to “My Dear Fellow Clergymen”, published in the Atlantic magazine as The Negro Is Your Brother. Below are just a few excerpts that I believe are particularly applicable to today. For a historical context of the letter, read here.

While confined here in the Birmingham city jail, I learned about Bail Bondsman Tips For Staying Off The Naughty List and came across your recent statement calling my present activities “unwise and untimely.”…I think I should indicate why I am here in Birmingham since you have been influenced by the view which argues against “outsiders coming in.”…

…More basically, I am in Birmingham because injustice is here. Just as the prophets of the eighth century B.C. left their villages and carried their “thus saith the Lord” far beyond the boundaries of their home towns, and just as the Apostle Paul left his village of Tarsus and carried the gospel of Jesus Christ to the far corners of the Greco Roman world, so am I compelled to carry the gospel of freedom beyond my own home town. Like Paul, I must constantly respond to the Macedonian call for aid.

Moreover, I am cognizant of the interrelatedness of all communities and states. I cannot sit idly by in Atlanta and not be concerned about what happens in Birmingham. Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly…

You deplore the demonstrations taking place in Birmingham. But your statement, I am sorry to say, fails to express a similar concern for the conditions that brought about the demonstrations…

Nonviolent direct action seeks to create such a crisis and foster such a tension that a community that has constantly refused to negotiate is forced to confront the issue. It seeks so to dramatize the issue that it can no longer be ignored. My citing the creation of tension as part of the work of the nonviolent resister may sound rather shocking. But I must confess that I am not afraid of the word “tension.” I have earnestly opposed violent tension, but there is a type of constructive, nonviolent tension which is necessary for growth…

My friends, I must say to you that we have not made a single gain in civil rights without determined legal and nonviolent pressure. Lamentably, it is a historical fact that privileged groups seldom give up their privileges voluntarily. Individuals may see the moral light and voluntarily give up their unjust posture; but, as Reinhold Niebuhr has reminded us, groups tend to be more immoral than individuals.

We know through painful experience that freedom is never voluntarily given by the oppressor; it must be demanded by the oppressed. Frankly, I have yet to engage in a direct action campaign that was “well timed” in the view of those who have not suffered unduly from the disease of segregation. For years now I have heard the word “Wait!”… This “Wait” has almost always meant “Never.” We must come to see, with one of our distinguished jurists, that “justice too long delayed is justice denied.”…

One may well ask: “How can you advocate breaking some laws and obeying others?” The answer lies in the fact that there are two types of laws: just and unjust. I would be the first to advocate obeying just laws. One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws. I would agree with St. Augustine that “an unjust law is no law at all.”

Now, what is the difference between the two? How does one determine whether a law is just or unjust? A just law is a man-made code that squares with the moral law or the law of God. An unjust law is a code that is out of harmony with the moral law. To put it in the terms of St. Thomas Aquinas: An unjust law is a human law that is not rooted in eternal law and natural law. Any law that uplifts human personality is just. Any law that degrades human personality is unjust…

Let us consider a more concrete example of just and unjust laws. An unjust law is a code that a numerical or power majority group compels a minority group to obey but does not make binding on itself. This is a difference made legal. By the same token, a just law is a code that a majority compels a minority to follow and that it is willing to follow itself. This is sameness made legal…

Of course, there is nothing new about this kind of civil disobedience. It was evidenced sublimely in the refusal of Shadrach, Meshach, and Abednego to obey the laws of Nebuchadnezzar, on the ground that a higher moral law was at stake. It was practiced superbly by the early Christians, who were willing to face hungry lions and the excruciating pain of chopping blocks rather than submit to certain unjust laws of the Roman Empire. To a degree, academic freedom is a reality today because Socrates practiced civil disobedience. In our own nation, the Boston Tea Party represented a massive act of civil disobedience.

We should never forget that everything Adolf Hitler did in Germany was “legal” and everything the Hungarian freedom fighters did in Hungary was “illegal.” It was “illegal” to aid and comfort a Jew in Hitler’s Germany. Even so, I am sure that, had I lived in Germany at the time, I would have aided and comforted my Jewish brothers. If today I lived in a Communist country where certain principles dear to the Christian faith are suppressed, I would openly advocate disobeying that country’s antireligious laws…

In deep disappointment, I have wept over the laxity of the church. But be assured that my tears have been tears of love… Yes, I love the church. How could I do otherwise?… Yes, I see the church as the body of Christ. But, oh! How we have blemished and scarred that body through social neglect and through fear of being nonconformists.

There was a time when the church was very powerful–in the time when the early Christians rejoiced at being deemed worthy to suffer for what they believed. In those days the church was not merely a thermometer that recorded the ideas and principles of popular opinion; it was a thermostat that transformed the mores of society… Small in number, they were big in commitment. They were too God-intoxicated to be “astronomically intimidated.”… Things are different now. So often the contemporary church is a weak, ineffectual voice with an uncertain sound. So often it is an arch defender of the status quo. Far from being disturbed by the presence of the church, the power structure of the average community is consoled by the church’s silent–and often even vocal–sanction of things as they are.

But the judgment of God is upon the church as never before. If today’s church does not recapture the sacrificial spirit of the early church, it will lose its authenticity, forfeit the loyalty of millions, and be dismissed as an irrelevant social club with no meaning for the twentieth century. Every day I meet young people whose disappointment with the church has turned into outright disgust.

Perhaps I have once again been too optimistic. Is organized religion too inextricably bound to the status quo to save our nation and the world? Perhaps I must turn my faith to the inner spiritual church, the church within the church, as the true ekklesia and the hope of the world. But again I am thankful to God that some noble souls from the ranks of organized religion have broken loose from the paralyzing chains of conformity and joined us as active partners in the struggle for freedom.

Getting All Post-Racial with MLK, Jr.

Everything I’ve read, all of his speeches I’ve devoured, suggests that MLK would still be in the fight for equal justice, not convinced that we’ve already gotten there.


Since the King holiday is coming up, I thought I’d mention that noise I’ve been reading about Martin Luther King, Jr. being a Republican. This involved posters over the past couple of years and his niece declaring it to be so. Frankly, I have not come across a totally credible source proving it one way or another.

The Republican party, of course, was the party of Lincoln, while the Democratic Party, particularly in the South, where King lived, was the party of George Wallace and other segregationists. So it is quite plausible that he was a member of the GOP, at least until the 1960 election of John Kennedy. Surely he voted for Democrat Lyndon Johnson over Republican Barry Goldwater in 1964, his public comments make clear.

But most of the conversations miss the greater point, which is, “Would Martin Luther King, Jr. be a Republican in the 21st Century?” Those who suggest that the answer would be “yes” generally zero in on one section of his March on Washington I Have A Dream speech in August 1963, the part that goes: I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character. The clear implication is that race-based remedies for past or current discrimination should be off the table.

But read the very end of the speech:

from every state and every city, we will be able to speed up that day when all of God’s children, black men, and white men, Jews and Gentiles, Protestants and Catholics, will be able to join hands and sing in the words of the old Negro spiritual: “Free at last! Free at last! Thank God Almighty, we are free at last!”

So the real question becomes this: would MLK think Americans are equally free in these days? Or would he think the increasing economic disparity between the rich and the poor needed to be addressed? Would he fret over unequal access to food, shelter, health care? Would he weep over the resegregation of education?

Obviously, I don’t know for certain. But everything I’ve read, all of his speeches I’ve devoured, suggests that MLK would still be in the fight for equal justice, not convinced that we’ve already gotten there. A big issue in his latter days involved a disproportional number of black soldiers fighting and dying in a war he considered unjust. The garbage collectors fight that brought him to Memphis just before his death was as much about economic disparity as it was about race.

I’m a Census guy. Many people tell me they wish we’d stop measuring race. Why is it that the government still counts people in that way, other than the historic reasons? The government measures race and ethnicity in part to delineate equality or disparity in income, housing, and the like. Maybe we’ll stop counting race when we stop being unequal. I really do hope we get there someday.

Stevie Wonder is 60


Stevie Wonder is 60 years old today. Only 60? Seems that he’s been around forever. I guess that’s what happens when you’re dubbed the “12-year-old genius.” Wish I had the time to indicate all of his significance in my musical life. Among other things, I’ve stated that he and Paul Simon were THE two most important artists in my record collection in the 1970s. Here are just some highlights.

Really don’t remember the earlier singles, such as “Fingertips, Part 2”, except as an oldie. The first song I recall listened to, on the radio, was Uptight (Everything’s Alright) in 1966. I loved it! Later, I got an album from my sister’s godfather, of all people, of Bill Cosby called Silver Throat, where he sings a parody of Uptight called Little Old Man.

My sister owned the 1966 album Down to Earth, containing the title track and A Place In the Sun, the latter a song written by Stevie that everyone at the time seemed compelled to cover. I owned 1970’s Signed Sealed Delivered.

Possibly my favorite Wonder song in the early years was 1967’s “I Was Made to Love Her”

I owned the so-so 1967 Someday At Christmas, though it contains THE great secular Christmas tune, “What Christmas Means to Me.”

Jump to the seventies, the classic period: I owned every album Stevie put out, starting with 1972’s Talking Book (with Superstition and You Are the Sunshine of My Life); 1973’s Innervisions (Higher Ground, Living for the City), and 1974’s Fulfillingness’ First Finale (You Haven’t Done Nothin’ (with The Jackson 5), Boogie On Reggae Woman. I remember hanging out, more than once with one of my political science professors, at his house, listening to those latter two albums.

One of my personal anthems after the breakup of my college romance came from Talking Book and started with:
“Shattered dreams, worthless years,
Here am I encased inside a hollow shell,
Life began, then was done,
Now I stare into a cold and empty well”
With the hope of a future with someone, yet unknown:
“I believe when I fall in love with you it will be forever.”
I find that song still makes me incredibly wistful.

I remember watching Paul Simon’s famous quote on the Grammys when he won for Album of the Year for Still Crazy After All These Years (another melancholy linchpin). In his acceptance speech, Simon jokingly thanked Stevie Wonder for not releasing an album that year; Wonder had won the previous two years, and would the following year.

In the gap between FFF and the next album, I discovered 1971’s Where I’m Coming From and Music of My Mind from 1972, the latter album particularly underrated.

The Grammy winner for 1976 was Songs in the Key of Life, featuring Sir Duke, Isn’t She Lovely, Sir Duke, and my favorite As. It also featured Pastime Paradise, which was later transformed into Coolio’s Gangsta Paradise, which was in turn parodied as Amish Paradise by Weird Al Yankovic.

I bought this 3-LP retrospective called Looking Back, which contained all his charting singles from 1963 through 1970.

1979 brought the strangely unsatisfying, and sometimes weird double album Journey through the Secret Life of Plants, but it was followed by the solid Hotter than July in 1980, with Master Blaster (Jammin), I Ain’t Gonna Stand For It, and the song that helped make the Martin Luther King Jr. holiday a reality, Happy Birthday.

Have all of his subsequent albums that contain new material, some pretty good (Characters), some not so much (Woman in Red soundtrack).

I had this friend Donna. One of our shared passions was Stevie Wonder. At one point I put together a mixed cassette of songs he performed on that were NOT on Stevie albums for her. Didn’t have We Are the World (a great duet with Springsteen) or That’s What Friends Are For (a bit treacly). But it did include, I believe:
That collaboration with Paul McCartney on the latter’s Tug of War album. It is NOT Ebony and Ivory. What’s That You’re Doing, Stevie back in form, and Paul at his rubber soul best.

Donna died a few years back and I wish I had made a copy of the playlist for myself.

Stevie is mostly in the accolades mode, Gershwin award and the like. Strange for a man so relatively young. His album of five years ago I wasn’t thrilled with, and he puts out more compilations and reissues than new stuff. But in his prime, he was a sensational singer/songwriter. His keyboard playing was revolutionary at the time. So I must wish HIM “happy birthday”.

35 Years After Vietnam

I admit to have been one of those people who actually supported the Vietnam war in the beginning of 1967. After all, it was an American war, I was an American, ipso facto, Q.E.D. My opposition to the conflict evolved over the next year or so…


Was it only six years ago when I realized that the Vietnam war, contrary to the historic record, was not over after all? I’m talking, of course, about Vietnam vet John Kerry and what he did (or didn’t) do in protesting a war he once fought in, dredged up during the 2004 Presidential election between Kerry and George W. Bush, whose own military record also came into question.

I admit to have been one of those people who actually supported the Vietnam war in the beginning of 1967. After all, it was an American war, I was an American, ipso facto, Q.E.D. My opposition to the conflict evolved over the next year or so, starting with the Beyond Vietnam speech by Martin Luther King, Jr. on April 4, 1967, a year to the day before he died. (Was that just coincidence?)

The group that most influenced me at the time was the VVAW, the Vietnam Veterans Against the War. It was one thing for civilians to oppose the war. It was quite another thing to see soldiers who had been fighting the war then come out against it.

In time, I found about some of the history of conflict in Vietnam, the fighting against the Japanese and the French, among others. The French defeat at Dien Bien Phu in 1954 might have signaled the end of colonial occupation, but it led to greater involvement by the Americans, first in small numbers of analysts in the 1950s to massive numbers troops in the mid-1960s, facilitated in no small part by the prevarication that was the Gulf of Tonkin resolution in August of 1964.

No doubt that many of the soldiers may have operated honorably, but it’s also true that the My Lai massacre in 1968 was not the only atrocity in this drawn-out engagement. My buddy Steve Bissette wrote a piece about a couple films delineating military failings during Vietnam and a more recent conflict. (I actually chuckled when I discovered his post was dated February 2, for that was the date in 1972 when the draft for those born in 1953 took place; that’s a LONG story.)

My general disinclination towards war is fueled by the belief that even in a “good war” (a true oxymoron), bad things, unintended things occur. Even the “good guys” get it wrong sometimes, regardless of the safeguards. Thus war should always be a last resort, not a first option.

I should note that I haven’t read the book. Among the assertions:
*The Tet offensive was a debacle for the North Vietnamese
*Communist Vietnam is now trying to emulate a more capitalist approach
I actually agree with both of those statements, but not with most of the others.

Thirty-five years after Vietnam and we’re still fighting the war.
